Nach einer kurzen Übersicht überDescartes' mechanistiche Theorie der somatischen Funktionen und der Reproduktion, wird in der vorliegenden Arbeit die Entwicklung dieser Theorie bis zur neuesten Zeit beschrieben. Sodann wird eine Übersicht gegeben über die vitalistische Theorie, welche unter wissenschaftlichen Forschern bis zur Mitte des vorigen Jahrhunderts vorherrschte. Dann werden die Gründe dafür angegeben, dass diese Theorie des Vitalismus ungefähr um diese Zeit verlassen wurde, um durch die mechanistische Theorie ersetzt zu werden. Diese ihrerseits ist jedoch auf einer unbegründeten metaphysischen Auffassung (...) vom Wesen der Wirklichkeit aufgebaut. Nehmen wir sie an, so können wir die synthetischen Einheit, die Gesamterscheinungsreihe, die wir unter dem Namen Reproduktion und Körperfunktion zusammenfassen, nicht richtig beschreiben. Der Begriff „Leben” ist eine Synthese aller Beziehungen, die zwischen dem Organismus und seiner Umwelt bestehen. Diese Auffassung des Lebens ist die Grundlage der Biologie, daher ist denn auch Biologie eine selbständige, unabhängige Wissenschaft.Zuletzt wird der Reflexbegriff behandelt. Die mechanistische Auffassung des Reflexbegriffes ist unrichtig, da alle Reflexfunktion synthetischen, oder integrativen Charakter hat. Wäre dem nicht so, dann würde das Nervensystem lediglich Chaos hervorzubringen imstande sein. Biologie, ohne die Gegebenheit des Lebens vorauszusetzen, ist unmöglich und wissenschaftliches Voraussagen auf dem Gebiete der Biologie ist überall nur auf Grund dieser Voraussetzung möglich.Après avoir donné un bref aperçu de la théorie mécanique cartésienne de l'activité corporelle et de la reproduction, l'article contenu dans cette revue trace le développment de cette théorie jusqu'à notre temps. Un bref aperçu est donné ensuite de la théorie vitaliste qui prévalait parmi les observateurs scientifiques jusqu'au milieu du siècle dernier. Après cela sont exposées les raisons pour lesquelles la théorie du vitalisme fut abandonnée de nos jours et il est démontré, qu'il est généralement admis que l'abandon de cette théorie implique l'adoption de la conception mécanique. Cette conception, cependant, est basée sur une conception métaphysique mal fondée se rapportant à la nature de la réalité et, en l'acceptant, nous ne pouvons exprimer ou décrire l'intégration qui apparait dans les phénomènes de reproduction et d'activité corporelle de toutes sortes. La vie c'est l'intégration soutenue s'étendant sur toutes les relations entre l'organisme et son entourage; et la conception de la vie, c'est la base de la biologie, de sorte que la biologie est une science indépendant.l'Article termine par une discussion de l'action-réflexe et démontre qu'une interprétation mécanique de l'action-réflexe est inadéquate, puisque l'intégration est incluse dans toute action-réflexe; car si tel n'était pas le cas, le système nerveux ne serait autre chose qu'un mécanisme à produire du chaos. La biologie ne peut pas se passer de la vie, comme sa conception fondamentale, et les prédicitions en matière de biologie sont toujours basées sur cette conception. (shrink)

In The Construction of Social Reality, John Searle develops a theory of institutional facts and objects, of which money, borders and property are presented as prime examples. These objects are the result of us collectively intending certain natural objects to have a certain status, i.e. to ‘count as’ being certain social objects. This view renders such objects irreducible to natural objects. In this paper we propose a radically different approach that is more compatible with standard economic theory. We claim that (...) such institutional objects can be fully understood in terms of actions and incentives, and hence the Searlean apparatus solves a non-existent problem. (shrink)

In this essay the authors provide arguments that teaching is an art and that teachers can learn much about their trade from a careful study of the performances of other artists. Artists and teachers have the same basic challenge: in order to be successful, both groups have to obtain and retain peoples’ attention. This also holds for popular music artists. Ten female student teachers specializing in the Pre-school and Foundation phases of schooling (four-to-six-year olds), and six lecturers from the Faculty (...) of Education at the University of the Free State, Bloemfontein, South Africa, participated in a workshop at a local game lodge. During the workshop, videos of ABBA songs and Mamma Mia! The Movie were analyzed and discussed. The theme of the workshop was “Being an Excellent Teacher: Appreciating ABBA.” The 4D-cycle of Appreciative Inquiry– Discover, Dream, Design and Destiny–was used as a methodological framework to identify numerous positive themes with possible classroom applications from the songs and the film. These themes were then connected to educational theory and embedded in the insights of Benny Andersson, Björn Ulvaeus, Judy Cramer and other people involved with ABBA. A reflective report by one student teacher about the impact the workshop had on her views of teaching and an excellent class that she presented is also included. (shrink)

The need to decolonise the academy and academic writing requires that methodology for research be chosen carefully. The methodology of a study reflects the researcher's point of departure or worldview, as well as their belief system. The current coronavirus disease 2019 (COVID-19) pandemic has drastically influenced the functioning of higher education institutes, as well as how scholars plan and execute their research. This includes investigation into the global environmental crisis that is widely researched from various disciplines. These disciplines tend to (...) develop and favour different methodologies. The purpose of this presentation was to report on the inquiry into a suitable methodology to study social discourses about the environmental crisis. The methodologies investigated were an eco-linguistic approach to Critical Discourse Analysis, combined with eco-criticism, which was linked to the concept of an eco-sophy, using the framework of Dark Green Religion. The umbrella-concept of Dark Green Religion as a theoretical framework allows the comparison and incorporation of disparate methodologies as well as discourses. This framework also gives prominence to the role of religion in societal response to the environmental crisis. Due to the study being situated in an African context and striving to implement a decolonising discourse, some suggestions were made on decolonising research methodology in higher education. CONTRIBUTION: This article's contribution to new knowledge centred around situating current and new research in Africa in the context of the COVID-19 pandemic and deliberating on the impact for future studies. The conclusion was drawn that the COVID-19 pandemic can be a catalyst for re-interpreting research methodology from a decolonised perspective. (shrink)

Ce recueil a pour but de montrer que Heidegger n'est pas seulement, et peut-etre pas d'abord, ce penseur solitaire de Foret-Noire pretant l'oreille a la voix de l'Etre, comme on s'est souvent plu a le presenter, et comme il a sans doute lui-meme contribue a le faire accroire: c'est un penseur extraordinairement attentif aux developpements philosophiques de son temps, dont la pensee s'est elaboree en grande partie en dialogue non seulement avec les Grecs, la pensee chretienne, l'existentialisme de Kierkegaard ou (...) encore la phenomenologie husserlienne, mais egalement avec ses predecesseurs immediats (Dilthey, Brentano, Bergson, Braig, York von Wartenburg), les ecoles neokantiennes de Bade (Rickert, Lask) et de Marbourg (Cohen, Natorp, Cassirer), ainsi qu'avec certains contemporains, tels Jaspers ou Scheler. Des ses debuts, sa pensee s'avere ouverte aussi bien aux avancees de la logique mathematique (Frege et Russell) que, plus tard, aux developpements de l'anthropologie et de la biologie de son epoque (von Uexkull). Cette mise en perspective, qui nous parait plus que jamais necessaire, permet ainsi de mettre en lumiere des aspects negliges de l'oeuvre, de mieux comprendre les sources et, peut-etre, certaines limites de celui qui demeure, malgre l'ombre qui pese sa pensee, l'un des plus grands philosophes du XXe siecle. Ce travail pose la question des critères de la „progression biologique“ , d'après les documents fossiles, dans le monde des organismes, c'est-à-dire de ce perfectionnement qui ne s'arrête pas à l'intérieur du cadre d'un phylum donné, comme le „perfectionnement de l'adaptation“, mais qui conduit, au-de-là de phylums de rang différent, à des types supérieurs, par exemple, des Poissons pas les Amphibies et les Reptiles jusqu'aux Mammifères ou aux Oiseaux. Deux groupes de critères y sont recensés en détail, leur contenu est (...) exposé, et on les examine pour voir s'ils caractérisent sans ambiguïté la „progression biologique“. Le premier groupe comprend les critères de „différenciation croissante“ et „d'intégration harmonique”. Ils sont fondés sur la différenciation morphophysiologique ou plus exactement sur la „totalité” des organismes, c'est-à-dire leur multiplicité dans l'unité. Le second groupe de critères, à savoir „indépendance croissante du milieu” et „autonomie individuelle croissante”, part des relations de l'organisme au milieu et aux autres formes vivantes et souligne la „subsistence” des individus, c'est-à-dire leur plus ou moins grande indépendence ou leur stabilité interne. Comme „totalité” et „subsistence” sont les éléments décisifs d'une définition biologique de l'individu, on peut dire que la „progression biologique“ d'un organisme est d'autant plus élevée que sa totalité et subsistence et par là son être individuel sont plus accusés.Tous les critères mentionnés ne sont pas uniformes. Les motifs de leur imprécision sont divers. Tout d'abord, il n'y a pas encore de définition unique et complète de l'individu biologique, de sorte qu'on ne peut circonscrire d'une manière univoque ce qui confère à un organisme une individualité plus forte ou moins forte. Ensuite les lignées au-delà desquelles s'accomplissent des perfectionnements, et dont l'une reste intérieur au phylum , tandis que l'autre le transcende , sont entrelacées si intimement et d'une façon si particulière qu'elles ne se laissent pas séparer franchement et décrire rigoureusement selon leurs signes distinctifs. Tout représentant d'un phylum, peu importe son palier, est en effet nécessairement inséré dans un milieu et en quelque façon spécialisé. Il n'existe pas des types à caractères phylétiques purs, qui ne montrent dans aucune direction un „perfectionnement de l'adaptation”, mais seulement des marques caractéristiques de la „progression biologique”. Enfin nous ne connaissons pas les restes fossiles que le développement ou la formation des grands phylums du règne animal, à savoir du rameau des Vertébrés et des divers groupes des Invertébrés, mais non pas le plus intéressant et le plus important, leur „progression biologique” jusqu'au degré d'organisation qu'ils présentent déjà à l'époque du Silurien ou plutôt du Cambrien. C'est cela seulement qui permettrait une vue plus profonde sur la nature de la „progression biologique”.Die Arbeit stellt die Frage nach den Kriterien des fossil belegten Biologischen Aufstiegs” der Organismenwelt, d.h. derjenigen Vervollkommnung, die sich nicht innerhalb des Rahmens eines gegebenen Bauplans hält, wie die „Anpassungsvervollkommnung”, sondern über verschiedenrangige Baupläne hinweg zu höheren Typen führt, z.B. von den Fischen über die Amphibien und Reptilien zu den Säugern bzw. Vögeln. Ausführlich werden zwei Gruppen von Kriterien besprochen, ihr Inhalt dargelegt und ihre Eindeutigkeit zur Charakterisierung des „Biologischen Aufstiegs” untersucht. Die erste Gruppe umfasst die Kriterien der „zunehmenden Differenzierung” und „harmonischeren Integration”. Diese legen die morphologisch-physiologische Differenzierung oder genauer die „Ganzheit” der Organismen zugrunde, d.h. ihre Vielheit in der Einheit. Die zweite Kriteriengruppe, nämlich „zunehmende Umweltunabhängigkeit” und „zunehmende individuelle Autonomie”, geht von den Beziehungen des Organismus zur Umwelt und zu andern Lebensformen aus und betont die „Subsistenz” der Individuen, d.h. ihr grösseres oder geringeres Losgelöstsein oder ihre Selbständigkeit. Da nun „Ganzheit” und „Subsistenz” die entscheidenden Elemente einer biologischen Definition des Individuums sind, lässt sich sagen, dass der „Biologische Aufstieg” eines Organismus um so höher ist, je stärker seine Ganzheit und Subsistenz und damit sein Individuumsein ist.Eindeutigkeit kommt allen genannten Kriterien nicht zu. Die Gründe für ihre Unschärfe sind verschiedener Art. Zunächst gibt es noch keine eindeutige und vollständige Definition des biologischen Individuums, so dass sich nicht eindeutig umreissen lässt, was einem Organismus eine stärkere oder weniger starke Individualität verleiht. Dann sind die Linien, über die sich Vervollkommnungen vollziehen und von denen die eine innerhalb des Bauplans bleibt , die andere aber über ihn hinausführt so innig und in so eigenartiger Weise miteinander verflochten, dass sie sich nicht sauber scheiden und in ihren charakteristischen Merkmalen genau beschreiben lassen. Jeder Vertreter eines Bauplans, ganz gleich von welcher Ranghöhe, ist nämlich notwendig in eine Umwelt eingepasst und irgendwie spezialisiert. Es gibt keine Typen mit reinen Bauplanmerkmalen, die nach keiner Richtung hin eine „Anpassungsvervollkommnung”, sondern nur Merkmale des „Biologischen Aufstiegs” aufweisen. Schliesslich kennen wir fossil nur die Entfaltung oder Ausgestaltung der Grossbaupläne des Tierreichs, nämlich des Wirbeltierstammes und der verschiedenen Gruppen der Wirbellosen, nicht aber das Interessanteste und Wichtigste, nämlich ihren „Biologischen Aufstieg” zu der organisatorischen Höhe, mit der sie sich im Silur bzw. im Kabrium bereits vorstellen. Das erst würde einen tieferen Einblick in das Wesen des „Biologischen Aufstiegs” vermitteln.This article deals with the question of the criteria for the “biological ascent” of the organic world, resting on fossil evidence. That is, of that improvement which is not only restricted to the framework of a given “general structure” as is the “improvement of adaptation”, but which also leads beyond general structures of differentiated levels to a higher type,e.g. from the fishes through the amphibians and reptiles to the mammals or birds. Two groups of criteria are discussed at length, their content exposed and their univocity for the characterisation of this “biological ascent” is examined. The first group includes the criteria of “increasing differentiation” and “more harmonious integration”. The basis for these is the morphological-physiological differentiation, or more exactly, the “totality” of the organisms,i.e., their variety-in-unity. The second group of criteria, “increasing independence of environment” and “increasing individual autonomy”, is derived from the relationships of the organism to its environment and to other living forms, and stresses the “subsistence” of individuals,i.e., their greater or lesser degree of independence or self-sufficiency. Now since “totality” and “subsistence” are the decisive elements in a biological definition of the individual, it may be said that the “biological ascent” of an organism is higher, the more perfect its totality and subsistence and therefore its individuality is.The criteria mentioned are not univocal. The reasons for this lack of clarity are varied. First of all, there is no univocal and complete definition of the biological individual, so that it cannot be exactly stated just what gives an organism a more or less perfect individuality. Then the lines, along which improvements are made, and according to which the one remains within the general structure and the other goes beyond the general structure , are so intimately and singularly bound together, that they cannot be cleanly distinguished, and their characteristic notes exactly described. For each representative of a general structure, regardless of its level, is necessarily fitted into an environment and somehow or other specialised. There are no types with only notes of the general structure which show in no direction an “improvment of adaption”, but only the signs of “biological ascent”. Finally, we only have fossil evidence for the development or deployment of the “great general structures” of the animal world, namely that of the vertebrates and of the different groups of invertebrates, not for the most interesting and most important, that is, their “biological ascent” to the level of organisation with which they are found in the Silurian or Cambrian periods. Only that would give us a deeper insight into the essence of “biological ascent”. (shrink)

La comparaison de la teneur en étain de trois groupes d'échantillons, bronzes grecs géométriques, bronzes orientaux, bronzes grecs orientalisants, montre que c'est ύ partir de la date de leurs contacts avec le Proche-Orient que les métallurgistes grecs du Ier millénaire ont utilisé le bronze proprement dit, Cu+Sn. La comparaison des teneurs en fer et en plomb montre que les Grecs ont appris des Orientaux un certain nombre de procédés de travail du métal, lors de la réduction du métal ou du (...) martelage. L'étude métallographique confirme cette hypothèse. (shrink)

Structured interviews were held with 149 registered nurses in seven countries in America, Asia, Australia and Europe concerning the feeding of severely demented patients who do not accept food. The most common reasons for nurses being willing to change their decision to feed or not to feed were an order from the medical head, a request from the patient's husband and/or the staff meeting. There was a connection between the willingness to feed and the ranking of ethical principles. Nurses who (...) were most prone to feed the patient most often gave a high rank to the ethical principle of sanctity of life, while those who primarily chose not to feed the patient gave a high rank to the ethical principle of autonomy. All nurses stressed the ethical principle of beneficence. Des interviews structurés ont eu lieu avec 149 infirmiers/ères dans sept pays en Amérique, Asie, Australie et Europe concernant l'alimentation des malades gravement dément qui refusent de manger. La raison la plus générale pour des infirmiers/ères d'être prêt à changer leures décisions de donner à manger ou non sont: un ordre du médecin, la demande du mari de la malade ou de la réunion du personnel. Il y avait un lien entre la volonté de nourir et le rang des principes éthiques. Les infirmiers/ères les plus enclins de nourir la malade le plus souvent donnaient un rang supérieur au principe éthique de la sainteté de vie, pendant que ceux et celles qui choisissaient de ne pas nourrir la malade donnaient un rang supérieur au principe éthique de l'autonomie. Tous insistaient sur l'importance du principe éthique de la bienfaisance. Konstruktive Interviews wurden mit 149 ausgebildeten Krankenschwestern und Pfleger in sieben Ländern in Amerika, Asien, Australien und Europa gehalten über die Ernährung von schwer von Dementia praecox leidenden Patienten, die das Essen verweigern. Die gewöhnlichsten Gründe des Pflegepersonals für die Bereitwilligkeit, ihre Entscheidung, zu ernähren oder nicht, zu ändern, waren Anordnungen vom medizinischen Chef, Anfragen vom Ehemann der Patientin und/oder einer Personalsitzung. Es bestand ein Zusammenhang zwischen der Bereitwilligkeit zur Ernährung und dem Rang der ethischen Prinzipien. Die Pflegenden, die sich am meisten neigten, die Patientin zu ernähren, gaben dem ethischen Prinzip der Heiligkeit des Lebens einen hohen Rang, während die, die meistens vorzogen, die Patientin nicht zu ernähren, gaben dem ethischen Prinzip der Autonomie einen hohen Rang. Alle Pflegenden legten grossen Wert auf das ethische Prinzip der Wohltätigkeit. (shrink)

La question des rapports du spinozisme à l’axiologie a fait l’objet de nombreux débats. Certains commentateurs considèrent Spinoza comme étant profondément immoraliste, alors que pour d’autres, il maintient l'ensemble des valeurs humaines. Spinoza a cherché à dépasser l’utilitarisme propre au conatus de chacun, afin de fonder un altruisme rationnel. Il souligne que le bien auquel l’homme aspire lorsqu’il suit la vertu, il le désirera aussi pour tous les autres hommes. Cependant, les moyens mis en œuvre pour démontrer cette thèse semblent (...) problématiques. Cet article analyse la logique de la coopération interhumaine élaborée par Spinoza, ainsi que son idéal de l’homme libre, montrant, qu'en fait, il n'a pas réussi à surmonter la nature profondément égoïste du conatus. -/- The question of the relationship between Spinozism and axiology has been the subject of much debate. Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. This article analyzes Spinoza's logic of interhuman cooperation, as well as his ideal of the free man, showing that, in fact, he failed to overcome the profoundly egoistic nature of conatus. -/- . Background: Recent changes to regulatory guidance in the US and Europe have complicated oversight of secondary research by rendering most uses of de-identified data exempt from human subjects oversight. To identify the implications of such guidelines for harms to participants and communities, this paper explores the secondary uses of one de-identified DNA sample collection with limited oversight: the Human Genome Diversity Project (HGDP)-Centre d'Etude du Polymorphisme Humain, Fondation Jean Dausset (CEPH) Human Genome Diversity Panel. Methods: Using a combination of keyword (...) and cited reference search, we identified English-language scientific articles published between 2002 and 2009 that reported analysis of HGDP Diversity Panel samples and/or data. We then reviewed each article to identify the specific research use to which the samples and/or data was applied. Secondary uses were categorized according to the type and kind of research supported by the collection. Results: A wide variety of secondary uses were identified from 148 peer-reviewed articles. While the vast majority of these uses were consistent with the original intent of the collection, a minority of published reports described research whose primary findings could be regarded as controversial, objectionable, or potentially stigmatizing in their interpretation. Conclusions: We conclude that potential risks to participants and communities cannot be wholly eliminated by anonymization of individual data and suggest that explicit review of proposed secondary uses, by a Data Access Committee or similar internal oversight body with suitable stakeholder representation, should be a required component of the trustworthy governance of any repository of data or specimens. The question of Spinozist determinism and necessitarianism have been extensively studied by commentators, while the relationship between the notions of divine will and free will still requires elaborate studies. Our article seeks to contribute to such research, by clarifying the analyses of these questions by authors that Spinoza has confronted: Maimonides, as well as other Jewish philosophers, and Leibniz who criticized Spinozist determinism. We will study the consequences of these analyses on two examples that Spinoza gave to refute free will, (...) namely the dream and the situation of Buridan's ass. -/- Résumé: La question du déterminisme spinoziste et du nécessitarisme a été largement étu-diée par les commentateurs, tandis que la relation entre les notions de volonté divine et de libre arbitre nécessite encore des études plus élaborées. Notre article cherche à contribuer à ces recherches, en clarifiant les analyses de ces questions par des auteurs auxquels Spinoza s’est confronté : Maïmonide, ainsi que d’autres philosophes juifs, et Leibniz qui a lui-même critiqué le déterminisme spinoziste. Nous étudierons les conséquences de ces analyses sur deux exemples que Spinoza a donnés pour réfuter le libre arbitre, à savoir le rêve et la situa-tion de l’âne de Buridan. (shrink)

Corporate social irresponsibility continues despite institutional pressures for socially responsible behavior, resulting in disasters like the Kalamazoo River Oil Spill and the Exxon Valdez Oil Spill. We conduct an in-depth abductive analysis of the Kalamazoo River Oil Spill to explain factors that enable corporate forgetting work projects. Specifically, we illustrate how a corporation’s political activities allow it to gain the power to suppress its mnemonic community’s voices, thereby attenuating an irresponsible event’s memory from the minds of its stakeholders, protecting its (...) image, and maintaining legitimacy in the shareholder and state’s eyes. We also highlight how the remembrance and forgetting of an irresponsible incident diverges between stakeholders based on their characteristics, future goals, and aspirations and whether they directly suffered from the disaster. Our research makes notable contributions to forgetting work literature by highlighting the importance of corporate political activities and context on the success of corporate forgetting work projects. L'apriorisme dont ils se réclament, fait à juste titre la marque de commerce de l'École (...) marginaliste autrichienne; Menger en a fourni les principes, von Mises la justification, et Rothbard s'est occupé de propager la doctrine de l'autre côté de l'Atlantique. For W. E. B. Du Bois, the tragedy of Reconstruction was that its achievements were overthrown and erased from collective memory. Du Bois’s Black Reconstruction corrects this, claiming enslaved people who fled plantations self-emancipated, thus enacting a “general strike against the slave system.” Yet Du Bois contravenes his general strike thesis when he quotes without rebuttal several Union officials who spoke of the formerly enslaved in degrading, nonagentic terms. I turn to Jacques Rancière’s politics of dissensus to understand why Du (...) Bois quoted such racist views without comment. In Rancière, political actors “stage a scene” of equality that is shared, even among parties in conflict. Recording conflicting perceptions of the strike, highlighting divisions that persist despite momentary advances of equality, Du Bois’s reading of the general strike is dissensual in Rancière’s sense, I argue. But Du Bois also offers a valuable corrective to Rancière, whose account of the first plebeian secession erases a different general strike from memory. Rancière reads the Aventine as an event of confrontation unconnected to the collective action that Du Bois summoned from the archive and named “general strike.”. (shrink)

“Naturalization” is the game in town in the science of mind and consciousness. How is it possible to give a naturalistic account of consciousness without simply denying its phenomenal, experiential and intentional component? I address this question by examining Dretske’s representationalist theses, showing that their main defect is the absence of any characterization of the structure of intentional/representational states, be it perception (presentation) or intuitive presentification. I conclude these considerations by indicating a series of difficulties a programme of “naturalizing” consciousness (...) has to confront when taking seriously what is shown by phenomenological analyses of consciousness and intentionality. On le considéra comme un mathématicien et logicien, un physicien et un psychologue fiable, mais son œuvre philosophique fut systématiquement distordue au gré des controverses franco-françaises. Nous mettons l’accent sur les lectures d’André Lalande et de Louis Couturat qui contribuèrent néanmoins à faire reconnaître en France l’originalité du père du pragmaticisme.Despite his efforts, the American philosopher Charles S. Peirce found hardly any interlocutors in France. He (...) was considered mostly as a mathematician and logician, a physicist and a reliable psychologist, but his philosophical work was systematically distorted in consequence of “Franco-French” disputes. We emphasize here the readings of André Lalande and Louis Couturat who made significant contributions towards the recognition in France of the originality of the founding father of Pragmaticism. A fundamental valuation of present day technology requires an investigation of its supporting metaphysics. Although technology ostensibly is the exact opposite of any kind of metaphysics, its metaphysical foundations, which co-determine its influence on values and worldview formation, can be indicated. Western technology is reconsidered from the perspective of Heidegger's critique on technology. Technology need not determine values in a deterministic way. We are challenged as created co-creators to give a human face to technology. Africa can be considered relatively free (...) of the influence of high technology. The way technology is imbedded in African metaphysics, myth and worldview is investigated from the perspectives of life force and ubuntu. Although the African example may be foreign to Westerners, it proves that it is possible to live in a technological world without losing the values indispensable to humanity. S. Afr. J. Philos. This paper responds to Antje du-Bois Pedain’s discussion of the wrongfulness constraint on the criminal law. Du-Bois Pedain argues that the constraint is best interpreted as stating that φing is legitimately criminalised only if φing is wrongful for other-regarding reasons. We take issue with du-Bois Pedain’s arguments. In our view, it is neither a necessary nor sufficient condition of legitimate criminalisation that φing is wrongful in du-Bois Pedain’s sense. Rather, it is a necessary condition of legitimate criminalisation that φing is (...) what we call bare wrongful —that is, that the reasons in favour of φing are defeated by the reasons against. Though du-Bois Pedain is critical of this view, we argue that her criticisms do not convince. (shrink)

La théorie du choix social qui s'est développée durant les dernières décennies, notamment dans la ligne des travaux d'Arrow et de Sen , ne s'est pas seulement soldée par une série de résultats négatifs exprimés dans les théorèmes d'impossibilité d'Arrow, de Sen et d'autres; ses notions centrales ont aussi été utilisées de manière fort variée au point que cette théorie souffre aujourd'hui d'un déficit important qui se traduit par de multiples indéterminations conceptuelles.
